Utah minimum wage 2026
The minimum wage in Utah is $7.25 an hour in 2026. Utah's rate is set by Labor Commission rule, and Utah Code 34-40-103 forbids it from exceeding the federal minimum, so the state can match the federal minimum but never go above it. Workers covered by the federal Fair Labor Standards Act are excluded from the state Act and paid the same rate under federal law.

What to know about the Utah minimum wage
Utah's minimum wage is set neither by a ballot measure nor by a figure in statute but by rule of the Utah Labor Commission, and the Utah Minimum Wage Act limits how far that rule can go. Utah Code 34-40-103 says the state rate may not exceed the federal minimum and requires the commission to review it at least every three years and whenever the federal rate changes.2 With the federal rate at $7.25 since July 24, 2009, the Utah rate cannot be higher.
The state Act then steps aside for most workers. Section 34-40-104 excludes anyone entitled to the federal minimum under the Fair Labor Standards Act, so those employees are paid the federal minimum.3 The Utah rate matters for jobs federal law does not reach, but it also excludes outside salespeople, immediate family, casual and domestic workers, seasonal staff of nonprofit camps, federal employees, prisoners, certain farm workers, students and apprentices employed by their school, and qualifying seasonal amusement workers.3
Two lower rates appear in the Labor Commission's guidance. An employer may pay a minor under 18 $4.25 an hour in 2026 during the first 90 days of employment, and tipped employees, adults or minors, may be paid $2.13 an hour in 2026 if tips bring their pay to at least the minimum wage.1 Workers owed between $50 and $10,000 can file a wage claim online with the commission's Utah Antidiscrimination and Labor Division; larger or smaller claims go to state court.1 Under Utah Code 34-40-106, no city, town or county may set a higher minimum wage or require its contractors to pay more.4

|---|---|
| Minimum cash wage | $2.13 an hour16 |
| Maximum tip credit | $5.12 an hour |
Tipped employees, adults and minors, may be paid $2.13 an hour in 2026 as long as tips plus base wage reach at least the minimum wage.
An employer that takes a tip credit must make up the difference whenever wages plus tips fall short of the full minimum wage for the workweek. See the tipped minimum wage guide.
Overtime and salaried staff
| Weekly overtime | No state rule; employers covered by federal law pay 1.5 times the regular rate after 40 hours a week58 |
|---|---|
| Daily overtime | None in state law |
| Exempt salary | The federal level, $684 a week ($35,568 a year) |
Utah has no general state overtime law. Employers covered by the federal Fair Labor Standards Act must pay time and a half after 40 hours in a workweek. Utah's minimum wage law excludes FLSA-covered employment.
Overtime at the minimum wage of $7.25 is $10.875 an hour. Salaried managers, administrators and professionals are exempt from overtime only if they meet the duties tests and are paid at least the exempt salary. See overtime rules in every state or calculate pay with overtime.
How the rate changes
The Labor Commission sets the rate by rule, may not set it above the federal minimum, and must review it at least every three years and whenever the federal rate changes (Utah Code 34-40-103).
Indexed to inflation: no. Not indexed; follows the federal $7.25.5

Who is covered
The Utah Minimum Wage Act does not apply to employees entitled to the federal minimum under the Fair Labor Standards Act, who are paid the federal minimum. It also excludes outside salespeople, immediate family, casual and domestic workers, seasonal nonprofit camp staff, federal employees, prisoners, certain agricultural workers, students and apprentices employed by their school, and qualifying seasonal amusement employees.
- The Labor Commission's Utah Antidiscrimination and Labor Division takes wage claims for $50 to $10,000, online, by mail, in person or by fax; claims outside that range go to state court.
- Once a wage claim is filed, the employer is given 10 business days from the division's letter to respond.
- Cities, towns and counties may not require their contractors to pay above the federal minimum, except where federal funds require it.
Cities and counties
Utah Code 34-40-106 bars cities, towns and counties from establishing or requiring a minimum wage above the federal minimum, including through their contracts, with an exception where federal funds require otherwise.
