What to know about the Florida minimum wage
Florida's wage is written into its constitution, in Article X, section 24, and the path to $15.00 came from Amendment 2, approved by voters in 2020. Before it, the state adjusted the rate each January 1 for inflation, reaching $8.65 in 2021.2 The amendment switched to fixed raises on September 30: $10.00 in 2021 and one dollar more each year until $15.00 on September 30, 2026.3 Indexing returns afterward, but on a different calendar: each September 30, starting in 2027, the state calculates an adjustment from the consumer price index for urban wage earners, and it takes effect the following January 1. The $15.00 rate therefore runs from September 30, 2026 through December 31, 2027, with the first inflation-based rate due on January 1, 2028.3
Tipped workers gained from every step because Florida freezes the tip credit at the federal amount from 2003, $3.02.3 Their cash wage moved to $11.98 on September 30, 2026 for employees who receive more than $30 a month in tips.1
No state agency investigates minimum wage claims. The Florida Department of Commerce publishes the rate and the notice employers must post, but enforcement is through the courts: a worker must first give the employer written notice of the claim, and the employer has 15 days to pay; if it does not, a court can award the unpaid wages, the same amount again as damages, and attorney's fees.7 The Attorney General may also sue and seek a fine of $1,000 per violation.7
Cities and counties are shut out. Florida Statutes section 218.077 bars them from requiring a different minimum wage or from using their contracts to set contractors' pay.4 Miami Beach adopted a local minimum wage in 2016, and the courts held it preempted by that statute.
Tipped employees
| Tip credit | Allowed |
|---|---|
| Minimum cash wage | $11.98 an hour136 |
| Maximum tip credit | $3.02 an hour |
For employees who receive more than $30 a month in tips, employers may count tips up to $3.02 an hour, the federal tip credit in 2003, so the cash wage is at least $11.98 from September 30, 2026 (Fla. Const. Art. X, s. 24(c)).
An employer that takes a tip credit must make up the difference whenever wages plus tips fall short of the full minimum wage for the workweek. See the tipped minimum wage guide.
Overtime and salaried staff
| Weekly overtime | No state rule; employers covered by federal law pay 1.5 times the regular rate after 40 hours a week58 |
|---|---|
| Daily overtime | None in state law |
| Exempt salary | The federal level, $684 a week ($35,568 a year) |
Florida has no general state overtime law. Employers covered by the federal Fair Labor Standards Act must pay time and a half after 40 hours in a workweek.
Overtime at the minimum wage of $15.00 is $22.50 an hour. Salaried managers, administrators and professionals are exempt from overtime only if they meet the duties tests and are paid at least the exempt salary. See overtime rules in every state or calculate pay with overtime.
How the rate changes
The fixed schedule under Amendment 2 ended with $15.00 on September 30, 2026. From 2027, the state calculates an inflation adjustment each September 30 using the consumer price index for urban wage earners and clerical workers (CPI-W), and the new rate takes effect the following January 1, so the first indexed rate arrives on January 1, 2028.
Indexed to inflation: yes. Indexed to CPI-W again after the $15.00 step of September 30, 2026; adjustments are calculated each September 30 and take effect January 1.7

Who is covered
Florida uses the federal Fair Labor Standards Act definitions of employer, employee and wage, so the federal exemptions also apply. Covered employees must be paid the state minimum for all hours worked in Florida.
- Voters approved Amendment 2 in 2020, setting $10.00 on September 30, 2021 and one-dollar raises each September 30 to $15.00 in 2026.
- Before September 30, 2021 Florida indexed its rate every January 1; it was $8.65 in 2021.
- Before suing for unpaid minimum wages, a worker must give the employer written notice and 15 days to pay (Fla. Stat. 448.110).
- Employers must post the Florida minimum wage notice (Fla. Stat. 448.109).
Cities and counties
Cities and counties may not require a minimum wage other than the state or federal rate, or use contracts to set contractors' wages (Fla. Stat. 218.077(2)). Miami Beach's 2016 local minimum wage was struck down as preempted.

Florida has no state agency that takes minimum wage claims. Under Florida Statutes section 448.110, a worker first gives the employer written notice of the unpaid wages; if the employer does not pay within 15 days, the worker can sue for the unpaid wages, the same amount again as damages, and attorney's fees. The Florida Attorney General can also bring enforcement actions. For jobs covered by federal law, a complaint can go to the U.S. Department of Labor's Wage and Hour Division. Federal law prohibits firing or otherwise retaliating against a worker for complaining about federal minimum wage rights.
