What to know about the Oklahoma minimum wage
Oklahoma's minimum wage law does not fix its own figure; it follows the federal minimum, which has been $7.25 since July 24, 2009. The Oklahoma Minimum Wage Act also excludes any employment covered by the federal Fair Labor Standards Act, so the federal law sets the wage for most Oklahoma workers.7 The state act matters only for employers outside federal coverage, and for them it draws a second line: employers with at least 10 full-time employees at one location, or more than $100,000 in sales, owe the federal rate, while the U.S. Department of Labor lists $2.00 as the rate for all other employers.7
Voters had a chance to change this in 2026. State Question 832, an initiative to raise the wage in steps to $15 in 2029 and then adjust it for inflation, was on the ballot at a special election on June 16, 2026, held alongside the statewide primary. It did not pass, and the Oklahoma Department of Labor continues to list $7.25.5
Oklahoma has no overtime law of its own, so overtime depends entirely on federal coverage. Tipped workers covered by federal law receive at least $2.13 an hour in cash in 2026, with tips covering up to $5.12.2 The Department of Labor's Wage and Hour Unit investigates claims for unpaid wages, missing final paychecks, illegal deductions and unpaid minimum wage or overtime, which can be filed online.1 Since 2014, 40 O.S. 160 has kept cities from setting any minimum wage of their own.3

There is no state figure or index. The rate follows the federal minimum and changes only if Congress or the Legislature acts.
Indexed to inflation: no. No dollar figure in state law; adopts the federal rate by reference.7

Who is covered
The Oklahoma Minimum Wage Act (40 O.S. 197.1 and following) covers employers with at least 10 full-time employees, or the equivalent, at any one location, or more than $100,000 in annual gross sales, unless federal wage law already covers them. Most larger employers therefore pay the federal minimum. Oklahoma has no overtime law of its own; federal overtime applies where federal law covers the job.
- Workers can file claims for unpaid wages with the Oklahoma Department of Labor.
- A 2023 bill to repeal the ban on local minimum wages died in committee.
Cities and counties
The Legislature has claimed the whole field of minimum wages and mandatory vacation or sick leave, so no city or other subdivision may set a minimum wage, and any such ordinance is void (40 O.S. 160, enacted in 2014).
